1. Purpose
These terms govern the use of the website polarisy.com and the Polarisy app, which we call together the Service. The Service is published by the company Polarisy, whose legal details are in the Legal Notice. Merchants who use the Polarisy Studio app are bound, in addition to these terms, by the Partner Merchant Terms.
By creating an account or using the Service, you accept these terms in full. If you do not accept them, please do not use the Service.
2. The Service
Polarisy lets you discover on a map the partner businesses that are near you, take part in the games and activities these businesses offer, earn points that you can then redeem for offers or rewards provided by these businesses, under the Loyalty Program Rules, and manage your account, your history and your rewards.
Polarisy acts as a technical intermediary between users and merchants. Offers and rewards are provided and honored by merchants, under their sole responsibility.
3. Your account
To use the app, you must be at least 16 years old and give us accurate information. You may hold only one account, which you access with an email address and a password or with your Google account. You are responsible for keeping your credentials confidential and for any activity carried out from your account, and you must tell us without delay if you notice any use that you did not authorize.
4. Free of charge
The Service is free for users. No purchase or payment is needed to play, earn points or obtain an offer. Some offers can then be used at the relevant business, under the conditions that business has set.
5. Games, points and ads
The detailed rules on earning points, replaying, expiry and redemption of points are set out in the Loyalty Program Rules. To replay certain games immediately, you may be offered the option of watching a rewarded ad, which always remains optional.
6. Prohibited conduct
You agree not to cheat or manipulate results, in particular by means of bots, scripts, a modified app, emulators or the exploitation of bugs. You also agree not to create several accounts in order to multiply your rewards, not to bypass replay limits, ad verification or security measures, and not to use the Service for unlawful or fraudulent purposes or in a way that infringes third-party rights.
It is likewise forbidden to disrupt the operation of the Service, to mass-extract its data, to try to access it without authorization, or to sell, transfer or trade your points or your account.
7. Intellectual property
The Service, its brand, logo, interfaces and content are protected by intellectual property law. We grant you a personal, non-exclusive, non-transferable and revocable right to use the app for your private use. The brands and content of merchants remain their property.
If you add content to the Service, for example a profile picture, you warrant that you hold the rights to it and you grant us a limited license to display it as part of the Service.
8. Third-party services
The Service relies on services provided by third parties, in particular for signing in to your account, mapping and advertising. Their use may be subject to their own terms.
9. Availability and changes
We strive to keep the Service continuously available, without being able to guarantee that it will never be interrupted, for instance because of a maintenance operation, an incident or a mandatory app update. We may change, suspend or discontinue certain features.
10. Suspension and termination
You can delete your account at any time by following the procedure described on the Account & Data Deletion page. For our part, we may suspend or delete an account, after warning you where possible, in case of breach of these terms or fraud. The points associated with the account may then be cancelled.
11. Liability
The Service is provided as is. To the extent permitted by law, Polarisy is not responsible for merchants' offers, products and services, or for their possible refusal to honor a reward in breach of their commitments, which you may report to us. Nor is it responsible for interruptions or damage caused by external factors, such as telecommunications operators, your device or a case of force majeure, or for use of the Service in breach of these terms.
Nothing in these terms excludes or limits the rights the law gives you as a consumer, or our liability for gross negligence, wilful misconduct or personal injury.
12. Personal data
How your personal data is processed is described in the Privacy Policy and in the Cookie Policy.
13. Changes to these terms
We may change these terms. Significant changes will be notified to you in advance in the app or by email, and continuing to use the Service after they take effect means you accept them.
14. Governing law and disputes
These terms are governed by French law. In case of a dispute, we invite you to contact us first at contact@polarisy.com in order to look for an amicable solution. You may also use the European online dispute resolution platform, available at https://ec.europa.eu/consumers/odr.
Failing an amicable resolution, the competent courts are those determined by the ordinary rules and, where you act as a consumer, those of your place of residence.
